HMD Global Oy files constitutional complaint in VoiceAgeEVS case

On 12 March 2026, HMD filed a constitutional complaint (Verfassungsbeschwerde) with the German Federal Constitutional Court in connection with the ongoing VoiceAgeEVS litigation. The constitutional complaint follows the judgment of the German Federal Court of Justice ("FCJ") of 27 January 2026 dismissing HMD's appeal.
HMD notes with concern that, despite the European Commission's formal amicus curiae intervention requesting the FCJ to forward its interpretation of EU law on the obligations of EU law on fair, reasonable, reasonable and non-discriminatory ("FRAND") terms and conditions for standard-issue patent ("SEP") holders, the FCJ has refused to make such a referral to the European Court of Justice ("ECJ"). HMD believes that the FCJ’s refusal to refer these fundamental issues to the ECJ violates its constitutional right to a fair trial by denying it judicial clarification from a court competent to interpret EU law.
Through its action, HMD seeks clarification on issues of EU law that have far-reaching implications for fair licensing practices, legal certainty and the functioning of technology markets in Europe.
This action reflects HMD’s ongoing commitment to constructive, bona fide FRAND licensing and to promoting a predictable, harmonised legal framework for innovators and industry players in the Single Market.
